These Terms and Conditions apply to safari, transportation, accommodation, flight-booking and other travel services arranged by Marock Safaris. By confirming a booking or paying a deposit, the client acknowledges that they have read, understood and accepted these Terms and Conditions.
1. Booking and Confirmation
A booking is confirmed only after Marock Safaris has:
- Received the required deposit or full payment;
- Issued written confirmation; and
- Confirmed the availability of the requested accommodation, transportation and other services.
Quotes and provisional reservations are subject to availability and do not constitute confirmed bookings.
The person making a booking on behalf of a group confirms that they are authorized to accept these Terms and Conditions for every traveller included in the booking.
2. Deposit and Final Payment
A non-refundable deposit of 30% of the total safari price is required to confirm a booking.
The remaining 70% balance must be paid no later than 45 days before the scheduled departure date.
Bookings made within 45 days of departure require full payment at the time of confirmation.
Flights, permits and certain accommodations may require immediate full payment. Any such requirements will be disclosed to the client before payment.
Marock Safaris may cancel a booking if payment is not received by the stated deadline. Applicable cancellation charges will still apply.
3. Prices
Prices are based on the itinerary, number of travellers, accommodation, transportation and services stated in the client’s written quotation.
Before confirmation, prices may change because of availability, exchange-rate movements, fuel costs, government taxes, park fees or supplier price changes.
After confirmation, Marock Safaris will make reasonable efforts to honour the agreed price. However, additional government taxes, park fees or other mandatory charges introduced after confirmation may be passed on to the client.
Unless otherwise stated, personal expenses, visas, vaccinations, travel insurance, gratuities, optional activities and services not listed in the itinerary are excluded.
4. Cancellation by the Client
All cancellations must be submitted in writing by email and become effective when acknowledged by Marock Safaris.
The following cancellation charges apply:
- More than 60 days before departure: 30% of the total booking price;
- 31 to 60 days before departure: 50% of the total booking price;
- 30 days or fewer before departure: 100% of the total booking price; and
- No-show or early departure: 100% of the total booking price.
The 30% booking deposit is non-refundable because it is used to secure hotels, lodges and other travel services.
Airlines, hotels, lodges, permits and other suppliers may impose stricter cancellation conditions. When applicable, their conditions will take priority and will be disclosed to the client where reasonably possible.
Bank, card-processing, currency-conversion and transfer charges are non-refundable.
No refund will be provided for accommodation, meals, transportation, activities or other services voluntarily missed or unused by the client.
5. Changes Requested by the Client
Requests to change travel dates, accommodations, routes or other arrangements must be submitted in writing.
Changes are subject to availability and the conditions imposed by hotels, airlines, lodges and other suppliers. The client is responsible for any additional price, administrative cost or supplier charge resulting from the requested change.
Marock Safaris cannot guarantee that a confirmed booking can be transferred to another date or traveller.
6. Changes or Cancellation by Marock Safaris
Marock Safaris may make reasonable changes to an itinerary when necessary because of weather, road conditions, wildlife movements, park closures, safety concerns, supplier changes or circumstances beyond its control.
When a significant confirmed service becomes unavailable, Marock Safaris will make reasonable efforts to provide a suitable alternative of comparable value.
If Marock Safaris cancels a trip for reasons within its control, the client will be offered an alternative arrangement, travel credit or refund for services not provided, subject to any non-refundable supplier costs.
7. Force Majeure
Marock Safaris is not responsible for delay, alteration or cancellation caused by events beyond its reasonable control. These may include severe weather, natural disasters, epidemics, government restrictions, border closures, civil unrest, strikes, transportation disruptions, security incidents or other unavoidable events.
Where possible, Marock Safaris will assist the client with alternative arrangements. Any additional costs and non-refundable supplier charges remain the client’s responsibility.
8. Passports, Visas and Health Requirements
Clients are responsible for ensuring that they possess valid passports, visas, travel documents, vaccinations and health certificates required for their journey.
Marock Safaris may provide general travel information but does not guarantee entry into any country or protected area. Costs resulting from missing or invalid documentation are the client’s responsibility.
Clients must inform Marock Safaris of any medical condition, disability, dietary requirement or other circumstance that may affect their participation in the trip.
9. Travel Insurance
Comprehensive travel insurance is strongly recommended. Coverage should include trip cancellation, medical treatment, emergency evacuation, baggage loss, travel delay and activities included in the itinerary.
The client is responsible for understanding the coverage and exclusions of their insurance policy.
10. Safety and Client Conduct
Clients must follow reasonable safety instructions given by Marock Safaris representatives, driver-guides, park authorities and accommodation providers.
Marock Safaris may end a client’s participation without a refund if their behaviour threatens safety, disrupts the trip, damages property or seriously affects other travellers.
Clients are responsible for loss or damage caused by their intentional, reckless or negligent conduct.
11. Wildlife and Travel Conditions
Wildlife sightings cannot be guaranteed. Safaris take place in natural environments where animal movements, weather and road conditions are unpredictable.
Travel times and itineraries are estimates and may change because of local conditions. Such reasonable changes do not automatically entitle the client to a refund.
12. Third-Party Suppliers
Marock Safaris arranges services supplied by independent hotels, lodges, airlines, transport companies, park authorities and activity providers.
These suppliers operate under their own terms and conditions. Marock Safaris will exercise reasonable care when selecting suppliers but is not responsible for an independent supplier’s acts or omissions except where liability cannot legally be excluded.
13. Limitation of Liability
To the extent permitted by law, Marock Safaris is not responsible for indirect or consequential losses, missed connections, loss of enjoyment, or loss or damage arising from circumstances beyond its reasonable control.
Nothing in these Terms and Conditions excludes or limits liability where doing so would be prohibited by applicable law.
14. Complaints
Clients should report any problem immediately to their driver-guide or Marock Safaris so that reasonable efforts can be made to resolve it during the trip.
A complaint that remains unresolved should be submitted in writing to info@marocksafaris.com as soon as reasonably possible after the trip.
15. Website Information
Marock Safaris makes reasonable efforts to keep website information accurate and current. Photographs are illustrative, and accommodation, vehicles, wildlife sightings and destinations may differ from what is displayed.
Website content may be corrected or updated without notice.
16. Intellectual Property
Unless otherwise stated, the Marock Safaris name, branding, written content and original website materials may not be reproduced or used commercially without written permission.
17. Governing Law
These Terms and Conditions are governed by the laws of Kenya. The parties should first attempt to resolve any dispute in good faith. Unresolved disputes will be subject to the jurisdiction of the courts of Kenya, unless applicable law requires otherwise.
